我國醫療法制的討論少見從個人資料保護的角度出發，本文以病歷為例，配合實際案例的改編，嘗試論述病歷與個人資料保護法之間的關聯性。同時介紹侵害個人資料時可能會出現的法律責任，並附帶討論當前個人資料保護法可能的修正方向。

Discussion on the medical legal framework in Taiwan seldom approaches from the perspective of personal data protection. This paper takes medical records as an example and, with adapted real-life cases, attempts to elucidate the correlation between medical records and the Personal Data Protection Act. Simultaneously, it introduces the potential legal liabilities that could arise from personal data breaches, while also delving into potential directions for amending the current personal data protection legislation.
