The Standard for Determining Medical Negligence in Criminal Cases
醫師基於醫療目的使用管制藥品，雖可排除毒品危害防制條例之適用。然，因管制藥品具有成癮性，為避免醫師於醫療過程不當使用管制藥品，故醫師施以管制藥品時，必須具有正當醫療目的，符合管制藥品適應症，且施用管制藥品過程必須符合醫療常規。
When doctors use controlled drugs for medical purposes, they may be exempt from the application of the Narcotics Hazard Prevention Act. However, due to the addictive nature of controlled drugs, to prevent doctors from inappropriately using controlled drugs during medical treatments, doctors must have a legitimate medical purpose, conform to the indications for controlled drugs, and the use of controlled drugs must be in accordance with medical guideline.
