信賴原則的操作前提，包括了行為人必須從事風險行為，且其法律效果為排除過失不法的歸責，而從事風險行為人之也必須對其他共同參與者存在信賴利益，否則無法動輒援引信賴規則，嘗試排除過失不法的歸責。

The principle of reliance presupposes a cooperative setting in which multiple actors jointly engage in risk-bearing conduct. Only where each participant’s expectation of others’ due care is normatively warranted may reliance serve to exclude attribution of negligent unlawfulness.
