Legal Boundaries and Regulatory Frameworks for Medical Imaging Management in Healthcare Settings: Balancing Patient Privacy and Healthcare Workplace Safety
隨著個人資料保護意識提升及醫療暴力事件增加,醫療機構在攝影、錄影與影像管理上,面臨病人隱私權與醫護安全維護之雙重挑戰。醫療影像屬於特種個人資料,廣泛運用於臨床診療、病程追蹤、醫學教育及醫療爭議證據保全等領域。本文從醫療機構管理與臨床實務角度出發,探討醫療影像管理之法規基礎、實務需求與法律風險。本文發現,現行法規對診間錄影、病房錄影及醫療影像利用仍存解釋空間,造成醫療機構法遵上的不確定性。為兼顧病人隱私、醫療品質及職場安全,本文提出醫療空間三級分級管理架構,並建構涵蓋收集、儲存、存取、利用及銷毀之影像全生命週期管理機制。本文主張透過風險分級、比例原則及資訊治理模式,建立兼顧病人權益、醫護安全與公共利益之醫療影像管理制度。
With growing awareness of personal data protection and the increasing occurrence of violence against healthcare professionals, healthcare institutions face the dual challenge of safeguarding patient privacy and ensuring workplace safety. Medical images constitute sensitive personal data and are widely used in clinical practice, disease monitoring, medical education, and the preservation of evidence in medical disputes. This article examines the legal foundations, practical needs, and potential risks associated with medical image management from the perspectives of healthcare administration and clinical practice.
The study finds that existing regulations governing consultation-room recording, ward surveillance, and the use of medical images remain subject to considerable interpretative uncertainty, creating compliance challenges for healthcare institutions. To balance patient privacy, healthcare quality, and occupational safety, this article proposes a three-tier classification framework for healthcare spaces and develops a comprehensive medical image lifecycle management model covering data collection, storage, access, utilization, and destruction.
This article argues that a risk-based and proportionate governance approach should be adopted to establish a medical image management system that effectively balances patient rights, healthcare worker safety, and the public interest.
