The Specialized Labor Division between the Attending Physician and Nurse Practitioner: Analyzing the Negligent Supervision of Attending Physician
The scope of practice of nurse practitioners (NPs) includes medical interventions and medical assisting interventions. The Paragraph 3 of Article 24 of Nurses Act regulates that NPs implementing medical intervention should be under the supervision of attending physicians. The law dictates the specialized labor division between the attending physicians and NPs as virtual division and, thus, attending physician could not apply the principle of reliance and declare not negligent. While NPs implement medical assisting interventions, what kind of division between attending physicians and NPs and whether the attending physicians could apply the principle of reliance and declare not negligent are questioned. This article intends to analyze those questions above.
