The Dispute about the Right to Complain

於醫療過失所致（重）傷害案件，醫病達成和解後，常會在和解書內加註病方「拋棄刑事告訴權」、「民事請求權」等語。但其法律效果究竟如何？一般民眾常有誤會。本文試以虛擬案例淺論民眾易忽略之處，並提出改進建議。

In cases of a mediation of disputes over medical malpractice causing serious physical injury, the agreement documents usually also state “the complaint would abandon civil claims and rights in criminal procedure”. Since some misunderstanding exists herein regarding the legal consequence of such statement, this article will give a broad overview and make comment on it.
