食品安全法的行政規制之生產經營行為規制分析【月旦時論】 試閱
The Analysis of Administration in Food Production and Business Operation Behavior of Food Safety Law Regulations
本文係針對新修訂之中華人民共和國食品安全法的規制進行分析。出於食品安全規制的立法需求,新法的行政規制從規制主體的視角可分為「權力性規制」或和「義務性規制」。從規制客體的視角,可分為「行為規制」、「產品規制」與「生產經營者規制」。本文嘗試從「權力性規制」的角度出發,按照對規制客體的分類,著重對新法中「行為規制」的立法目的、制度設計、實證進行分析。分析研究的框架從理論分析到實證研究的路徑,對每一類「行為規制」的分析都分為原理分析與實效性分析兩個方面展開。
This article is to the newly revised “Food Safety Law” analysis of the regulation. Demand for food safety regulation of legislation, the new law of administrative regulation from the Angle of regulation subject can be divided into “power regulation” or “compulsory regulation.” From the perspective of regulation object can be divided into “behavior regulation,” “product regulation” and the “regulation” production and business operators. This paper from the perspective of “power regulation,” according to the regulation object classification, focuses on the law of “behavior regulation” the purpose of legislation, system design, the empirical analysis. According to the framework of analysis and research from the theoretical analysis to the path of the empirical research, analysis of each kind of regulation “behavior” is divided into principle analysis and efficiency analysis of two aspects.
