本文介紹一則護理人員與雇主(醫院)簽立「最低服務年限暨違約金約款」後,惟未服務滿最低服務年限,即提前離職,遂遭醫院求償違約金之判決。本文旨在說明法院如何以民法第247條之1第3款「顯失公平」之規定,參以「最低服務年限暨違約金約款」之「必要性」與「合理性」要件,作為判斷護理人員應否賠償醫院違約金之依據。
This essay introduces a judgement. One of the nursing staff was accused of the default fine by the employer (hospital) due to the early separation on the condition of agreed clauses for the minimum of the length of service. This essay explains whether the nursing staff was sentence to pay the default fine on the ground of “unfair” according to paragraph 247a No.3 Civil Law, the necessity and rationality of the agreed clauses for the minimum of the length of service and the default fine.
