受僱醫師之職業災害救濟【本期企劃】 試閱
The Workers' Compensation System Applied to Employed Doctors
受僱醫師於執行職務時遭遇職業災害之情形,其實與一般勞工無異,只要係起因於執行職務所致之傷病,皆應肯認其為職業災害。然臺灣的職業災害救濟制度係由:一、勞動基準法上之雇主補償責任;二、勞工保險條例之職業災害保險給付;三、職業災害勞工保護法之補助與津貼;四、民法上之損害賠償責任所構成。受僱醫師因為受限於其並不適用勞動基準法,於職業災害救濟制度的拼圖上已明顯少了重要的一塊,則其是否能請領職業災害勞保給付、職業災害勞工保護法之補助與津貼,以及民法上的損害賠償,應進一步加以探討。
The condition of employed doctors suffering from industrial accidents has no difference from that of ordinary labors, as long as occupational injuries are arising out of and occurring in the course of employment. The workers?compensation system in Taiwan comprises four separate legal mechanisms, including 1. employers?compensation liability under the Labor Standards Act; 2. occupational injury insurance benefits under the Labor Insurance Act; 3. subsidy and allowance granted under the Act for Protecting Worker of Occupational Accidents; and 4. civil liability for damages. However, since the Labor Standards Act does not apply to employed doctors, the compensation system for them has lacked an important method. Accordingly, it is imperative that studies further investigate and discuss whether or not the employed doctors can claim the compensation for occupational injuries by means of the remaining three mechanisms.
