臺灣毒品施用現況、影響與除罪化之可行性【本期企劃】 試閱
Impacts and Decriminalization Issues of Illegal Drugs in Taiwan
近年毒品施用對個人及社會各層面之衝擊甚巨，惟其在臺灣之實際施用現況及衝擊面向有待釐清。另受加拿大及美國部分州開放娛樂性大麻合法使用之影響，臺灣是否有除罪化之條件，或與部分先進國家同步合法化開放使用仍具有爭議，有待深入檢視。為此，本文從官方統計與自陳報告等視角檢視臺灣毒品施用問題之現況，並與國際間毒品施用之情形初步比較；其次，本文介紹現行毒品施用對人體身心健康及整體社會與治安之影響，以學理及實證研究資料佐證；同時整理歐洲與亞洲國家現行針對藥癮者施用毒品之新近制裁措施，以了解歐亞各國毒品施用制裁政策之發展現況；再者，本文聚焦討論毒品合法化與除罪化等具爭議性之問題，包含健康之影響、各國之施行經驗等。最後，本文立基於前述文獻與討論，對臺灣對施用毒品政策進行檢視並提出評論與建議。
The impacts of illegal drug use have exerted substantial public concern, however, the prevalence and influences are unclear. Furthermore, the decriminalization for cannabis use in Canada and part states of USA have produced influences on many countries, such legislation is applicable to Taiwan or not requires further discussion. In response to the issues, the paper examines the current prevalence of illegal drugs through official reports and self-reported studies conducted in Taiwan. At the same time, a preliminary comparison for countries across the world is conducted. Secondly, the paper introduces the potential impacts of illegal drug uses by scientific and clinical practice. The paper further examines the penalty for drug use in major countries in the European and East/South area. The paper further discusses the issues/ debates between decriminalization and criminalization for drug uses in different countries. Finally, the study attempts to propose adequate drug policy for illegal drug use in Taiwan.
