雖於通訊診察治療辦法發布並施行後已對數種特殊情形開放通訊診察,由於臺灣的遠距醫療系統正逐步發展中,在醫療儀器與網際網路的互相配合下,相關醫療行為或許會超出「親自診斷」與「遠距診察」兩種模式。如監控數據判讀出錯或機器故障導致判斷數據錯誤、軟體(雲端資料庫)硬體醫療器材製造商之民刑事責任及醫事人員責任,分別如何歸責及分擔。對遠距智慧醫療行為與AI輔助醫療行為之法律責任部分集中在醫療軟體、硬體製造商侵權行為責任、大數據雲端判讀醫療資料之是否屬於醫療行為,以及如屬醫療行為,以數位智能醫療、精密儀器之應用的法律責任為主題。在臺灣,政府還沒有意識到遠端醫療服務的使用者權利、某些設備∕軟體製造商的衍生責任,以及人工智慧設備的法律問題。

英文摘要

“Rules of Medical Diagnosis and Treatment by Telecommunications” established by the Ministry of Health and Welfare, restrictions on implementing telemedicine in Taiwan have been relaxed in special circumstances. Part of the legal liability discussions regarding digital medicine focus on the of civil negligence/infringement responsibility, for instance, whether using the medical data in the big-data cloud belongs to medical behavior. If there is an error in the interpretation of the monitoring data, or the machine failure leads to an error in the judgement-based data, it is challenging to impose and distribute the civil and/or criminal liability to the medical personnel as well as the software (internet and cloud database) and hardware (medical equipment) manufacturers. The Taiwanese government hasn sensed the users?right of telemedicine service and legal issues with artificial intelligence-assisted devices.
