Refusal to Testify by Medical and Healthcare Personnel— A Privilege or an Obligation?
對於刑事訴訟法第182條「因業務關係之拒絕證言權」的解釋,我們必須透過結合憲法所保障的基本權、現代醫學倫理以及刑法第316條的規範目的來理解。在刑事訴訟法第182條所規定的醫事人員得到本人(病人)同意之前,拒絕證言並非其權利,而是義務。對於不在條文規定內的醫事人員,亦應基於其法定保密義務而類推適用刑事訴訟法第182條的規定。
Article 182 of the Code of Criminal Procedure “Testimonial Privilege Related to Occupations” shall be interpreted in combination with the fundamental rights guaranteed by the Constitution, the modern medical ethics and the regulatory purpose of Article 316 of the Criminal Code. Before the medical and healthcare personnel, who are regulated under Article 182 of the Criminal Procedure Law, obtain the consent from the patient himself, refusal to testify is not a privilege but an obligation. The provisions of Article 182 of the Code of Criminal Procedure shall also be analogously applicable to the medical and healthcare personnel, who are not covered by the Article 182 of the Code of Criminal Procedure, based on their statutory duty of confidentiality.
