The Criminal Liability of the Medical Violence in Outpatient Clinic
門診是醫療行為發生的主要場所之一，相較於急診與病房，具有隱私性與非公開性，也影響了醫療暴力行為的認定。本文以設計案例導入診間暴力之情境，解析目前醫療法上「妨礙醫療業務執行罪」之構成要件，以及醫療暴力現行犯認定與警察機關之義務。
Outpatient clinic is one of the main places where medical practice occurs. Compared with emergency room and ward, it is private and non-public, and it also affects the identification of medical violence. This article introduces the situation of violence in clinic with a designed case, and analyzes the constituent elements of the “crime that hinder the execution of medical practices” in the current medical law, as well as the identification of flagrante delicto and the obligations of the police for medical violence.
