在醫療訴訟中，醫審會之鑑定是法院認定事實重要的證據之一，然而醫審會鑑定有其機關鑑定之缺陷，法院要如何克服並正確提出有助釐清醫療行為中真正重要之待證事實，並且設法提高鑑定結果之證明力，必須先理解醫審會鑑定有何問題，進而去蕪存菁，方能正確解讀鑑定意見。
The court’s testimony by the medical review committee in the medical legal suits is one of the most important pieces of evidence for the court to determine the facts. However, there are shortcomings of the testimony by bureau concerning to the medical review committee. The court must first understand the problems of it and then eliminate the weaknesses in the testimony in order to interpret it’s result correctly.
