The Beginning of Dwindling Parental Responsibility
未婚之未成年人如依現行優生保健法第9條第1項之規定實施人工流產，則應得其法定代理人之同意，然此一限制是否允當，非無疑問；衛生福利部對此於2022年提出優生保健法之修法草案，就未成年人與其法定代理人對於人工流產決定之意見不一時，增設司法或行政機關介入之機制。有鑑於此，本文擬從比較法觀點，分析父母得否以親權行使為由，拒絕其未成年子女實施人工流產；另父母如以宗教因素為由，此時又該如何予以評價。
Both the United States and the United Kingdom have regulations on the practice of minor children’s abortion, separated from exercising parental responsibility. In Taiwan, unmarried minors must obtain the consent of their legal representatives to perform abortions before 2023. However, under the new Civil Code, the age of majority has dropped to 18; the Ministry of Health and Welfare proposed in 2022 that if the legal representative disagrees, it must be submitted to the court for adjudication as soon as possible. How to strike a proper balance between exercising parental responsibility and the abortion decision of minor children is worthy of discussion.
