Infection after Open Reduction and Fixation of Fracture: Extinctive Prescription of Claim in Medical Malpractice
本件病人因骨折就醫，經醫師以鋼板鋼釘固定並置入磷酸鈣，術後發生感染，雖經治療但終致骨折處癒合畸形，因而主張醫療過失請求損害賠償。各審級法院均認定醫療無過失，並認醫療傷害請求權已罹於消滅時效。本文擇消滅時效之論述為評析主軸，介紹實務對民法第197條第1項消滅時效之解釋，以及該條項時效規定於醫療契約履行利益受侵害時之目的性限縮準用。
The plaintiff, a victim of humerus fracture, was admitted for open reduction and internal fixation and was complicated with malunion due to infection. He filed the medical malpractice action against physician and the hospital claiming for the penalty for damages, however the courts found for the defendant. This article will comment on the issue of extinctive prescription herewithin with special emphasis on the application of §197 in Civil Code.
