告知後同意理論在刑法犯罪論中所扮演的角色眾說紛云,本件案例係完全欠缺病人同意之侵入性醫療行為的典型,法院完全忽略專斷醫療行為是否該當故意傷害構成要件,更甚者逕將醫師臨床裁量空間無限放大,利益衡量成為阻卻違法之唯一考量,而此利益卻完全毋庸考量病人自主決定之想法,更扭曲告知後同意理論對於醫師防禦性醫療之正面效益,有悖於病人自主權利法之立法精神及世界潮流,應更審慎思考。
The role of informed consent theory has always been a controversial issue by the theory of Criminal Law. This case is typical of the invasive medical behavior fully without the patient’s consent. The practice of the court completely ignores whether the arbitrary medical behavior would be the element of intentional injury. What’s more, is the scope of the physician’s clinical discretion infinitely magnified, and the measure of interest becomes the only consideration to affirmative defense. This kind of interest doesn’t take the idea of the patient’s self-determination into account, and even distorts the positive benefit of the informed consent theory in the physician’s defensive medical treatment. This practice is contrary to the spirit of the patient’s autonomy law and the world trend, and should be considered more carefully.
