Product Liability of Orthopedic Medical Devices-Comments on the Case of Titanium Alloy Plate Fractures

病患自費向就診醫院購買骨科醫療器材，從事設計、製造與經銷之醫療器材商以及醫院自應負消保法之商品責任。本文研析鈦合金鋼板斷裂案，分析相關商品責任主體之歸責事由及判斷鈦合金鋼板瑕疵之認定標準。

When patients purchase orthopedic medical devices from hospitals, designers, manufacturers, distributors, and hospitals are liable under the product liability provisions of the Consumer Protection Act. This study analyzes the case of titanium alloy plate fractures, investigating the grounds for liability of relevant responsible parties and the criteria for determining defects in titanium alloy plates.
