醫療法修正初探（一）
Preliminary Analysis of the Amendments to the Medical Care Act (I)
本文以立法院2026年8月25日三讀通過之《醫療法》部分條文修正案為中心，分析本次修法所涉及之六項彼此獨立的政策問題，包括醫療現場安全、病人醫療隱私、醫療社團法人治理與資金、醫療廣告主體、偏鄉醫療租稅誘因及醫事鑑定具名方式。本文認為，本次修法之立法動因可區分為回應違憲宣告、回應制度停擺及政策主動加碼三類，其正當性密度有所不同。進一步檢視各項修正可見，醫療暴力部分確有實證研究所揭示之規範漏洞，惟單純提高刑度之實效仍有疑義；醫療隱私之強化則須兼顧病人權益與醫療暴力案件之蒐證需求；醫療社團法人開放法人社員及偏鄉租稅優惠，其制度效果仍有待後續實證驗證；第100條之1雖回應醫事鑑定停擺之急迫需求，卻未完整處理鑑定透明性、利益迴避及當事人詰問權等問題。本文主張，本次修法之成效不能僅由條文文字判斷，仍須透過子法、執法及司法實務之持續檢驗，始能評估其在醫療安全、病人權益、專業自主與司法正義間所形成之制度平衡
This article examines the partial amendments to Taiwan’s Medical Care Act passed by the Legislative Yuan on August 25, 2026. The amendments address six distinct policy issues: medical workplace safety, patients’ medical privacy, the governance and financing of medical incorporated associations, medical advertising, tax incentives for healthcare professionals in underserved areas, and the identification of medical experts in forensic appraisal. The article classifies the legislative motivations into three categories: responding to a constitutional ruling, addressing institutional dysfunction, and pursuing proactive policy objectives. It argues that the legitimacy of the amendments varies accordingly. The provisions concerning medical violence address regulatory gaps identified by empirical studies, although the effectiveness of harsher penalties remains uncertain. The strengthened protection of medical privacy must also be balanced against evidentiary needs in medical violence cases. The opening of medical incorporated associations to corporate members and the tax incentives for underserved areas require further empirical evaluation. As for Article 100-1, although it responds to the urgent suspension of medical forensic appraisals, it does not fully resolve concerns regarding transparency, conflictof- interest safeguards, and the parties’ right to examine expert evidence. The article concludes that the effectiveness of the amendments should be assessed not merely by their statutory language, but through subsequent regulations, enforcement, and judicial practice.
