本篇文章探討急診醫療中「告知後同意」制度的實務困境。隨著急診壅塞與醫療人力不足日益嚴重，醫療人員在有限時間內難以完整履行說明義務。除了需依處置之風險與緊急程度調整說明內容，並採取「理性醫師標準」以取代「理性病人標準」。此外，對於例行性、標準化的說明，亦可由授權的醫療人員代為進行。最終，在健保制度的設計上應更重視分級醫療、護病比乃至醫病比的規畫，以維持民眾就醫的品質。

As emergency departments face increasing overcrowding and staff shortages, healthcare professionals often find it difficult to fully meet their duty of explanation within limited time constraints. It is necessary to adjust the content of disclosure based on the risk and urgency of medical procedures, and to adopt the “reasonable physician standard” in place of the “reasonable patient standard.” Moreover, routine and standardized explanations may be delegated to authorized medical personnel. Ultimately, the national health insurance system should place greater emphasis on hierarchical medical care and the planning of nurse-to-patient and physician-to-patient ratios to maintain the quality of patient care.
