醫師過勞職災判決評析——兼論受僱醫師納入勞動基準法【本期企劃】 試閱
The Judgments Analysis of Physician Burnout Occupational Injury:Also Discussing the Labor Standards Act applies to Employed Physicians
醫師納入勞動基準法適用之呼聲非始於最近,但直至近年來因醫師過勞導致職災的事件頻傳,才有更多人開始關注醫師過勞問題,醫師勞動條件改革小組即在此背景下應運而生,開始呼籲醫師納入勞動基準法以降低工時預防過勞,並保障職災補償。本文以○○醫院蔡○○醫師之職災判決為例,探討工作負荷、工時認定及與有過失之問題,提出納入勞動基準法後對此類爭議應能賦予醫師有更有利的法律地位,以及從該案中延伸出納入勞動基準法後恐將面對的工時認定挑戰。
The Labor Standards Act has been taken into effect in 1984, and it’s not recent issue about whether the Labor Standards Act applies to employed physicians or not.
However, more and more physician burnout occupational incidents occur, which makes people pay more attention to this issue.
In this study, we’ll use a physician burnout occupational case to discuss about workload, work hour and how to define whether physicians negligently contributed in causing the injury or not. At last, we’ll discuss about the problems if the Labor Standards Act applies to employed physicians.
