醫療廣告應在客觀上有刊登醫療廣告資訊之行為,且行為人於主觀上並有「宣傳醫療業務,以達招徠患者醫療為目的」者,始足當之。單純於醫師個人之臉書平臺分享醫學研究文章及相關醫學新知之行為,應不致使社會大眾誤信錯誤醫療訊息而使其生命、健康遭受危害,故應非醫療廣告。

英文摘要

By fulfilling these elements that it should objectively be advertising informations for medical advertisements, and that the offender should subjectively have the purpose of romoting the medical business to attract patients seeking medical advice,?it would be a medical advertisement. In contrast, it should not be false medical information and leads necessarily no damage of life or health to patients as the result either, if a physician only posted medical research articles and relevant medical news on Facebook. These would be no medical advertisement consequently.
