重構「教化可能性」,其實是面對必要之惡不得不然的做法。在死刑案件之量刑程序中,以概念極端模糊的教化可能性作為量刑基準時,司法實務工作者應從教化可能性在行為科學上展現的無矯治可能性、無再社會化可能性,以及有高度再犯風險等三具體內涵之標準入手,搭配行為科學專家在此架構下針對被告提出合乎證據法則與正當法律程序的鑑定意見後,進行證據調查與判斷。但最終,司法仍必須正視教化可能性作為生命刑量刑基準的恣意本質。

英文摘要

Reconstructing the “beyond reform” test is at best a reluctant practice, if we deem such test a necessary evil in capital cases. Three concepts should be closely examined and assessed when attempting the “beyond reform” test in capital cases: lack of correctability, lack of re-socialization possibility, and high potential of recidivism. Evidence should be thoroughly investigated, evaluated and argued in court whenever a capital case involves such test. But in the end, it is imperative that all practitioners of law stare into the arbitrariness and absurdity of such a standard as the core concept of capital sentencing in Taiwan.
