Ethical and Legal Considerations for International Reproductive Tourism
隨著國際醫療旅遊的蓬勃發展,以及臺灣人工生殖技術的進步,越來越多外國人以旅遊方式來臺尋求人工生殖的協助。然而,不同於在本國進行人工生殖,跨國生殖旅遊可能涉及不同國家的法規範、倫理觀念及社會輿論的差異,造成回到本國後生活上的困難及子女權益的受損。此外,若執行生殖醫療的過程當中發生糾紛,也會因各國法制的不同而影響生殖醫療接受者之權益。因此,本文將從各國倫理、法律制度的整理出發,進一步檢討臺灣法規範,以期提供制度改進之方向。
With the rapid development of international medical tourism and the advancement of artificial reproductive technology in Taiwan, more and more foreigners travel to Taiwan to seek help from artificial reproduction. However, unlike artificial reproduction in the home country, transnational reproductive tourism may involve differences in legal norms, ethical concept, and public opinion in different countries, resulting in difficulties of life after returning home country, as well as impaired children’s rights and interests. If there is any dispute on executing reproductive health care, the rights and interests of the recipients will also be affected by different national legal systems. Therefore, this article will collect different ethics and legal systems, and further review the norms of our country’s laws and regulations in order to provide a direction for system improvement.
