The Range of Compensation Because of Breach the Duty of Disclosure
Taking an invasive procedure like performing a surgery is certainly dangerous. The Principle of informed consent according to paragraph 63 section 1 Medical Care Act indicates that the patient could know the danger from the invasive procedure and could decide by himself to take it. It could lead to the injury of the right of personality like the autonomy of patient that the duty of disclosure was breached. However, the question whether the reduction of labor force and the cost of nursing workers should be included in the range of compensation, has still different opinions. It would be discussed in this article as a reference.
