代孕議題向來是人工生殖最具爭議性的議題之一。本文針對我國30年來代孕遲未合法化的重大癥結點及可能的對策加以分析，包含是否應有償、如何減少對代孕者的剝削、法律上親子關係之建立、誰有權利近用代孕服務等。如何妥適維護人民生育權、強化代孕者自主權以及保障代孕子女之最佳利益，在在考驗法規設計者的智慧。
Surrogacy is one of the most controversial issues concerning assisted reproductive technologies. This essay analyzes the main sticking points that cause the delay of legalizing surrogacy in the past 30 years. Issues include monetary compensation to the surrogate mother, how to prevent exploitation, problems in establishing legal parentage and the access to surrogacy services. All of them pose challenges to legislators who care to properly protect reproductive freedom of people, the surrogate mother’s bodily autonomy and the resulting child’s best interests.
