Further Exploration of Criminal Misconduct in Food Safety Regulation: Considering the Perspective of Legal Interests
食品安全問題在近10餘年來一直是社會高度關注的新興事件，食品衛生安全管理法呼應輿情，加重刑罰強度，並納入新型態的犯罪態樣，惟是否能夠徹底解決消費者的憂慮，其實仍有疑義，再者，相關的修正方向，似乎也與刑法的基礎原理存在扞格的風險，值得吾人重新檢視。
Food safety issues have been a highly concerning emerging event in society over the past decade. The Act Governing Food Safety and Sanitation responds to public sentiment by increasing the severity of penalties and addressing new forms of criminal behavior. However, whether it can completely resolve consumer concerns remains questionable. Furthermore, the direction of these amendments appears to pose risks of conflict with the fundamental principles of criminal law, warranting a reassessment.
