Legal Issues of Organ Donation from Deceased Terminally Ill Patients
目前我國屍體器官捐贈包含「腦死後器官捐贈」及「心臟停止死亡後器官捐贈」兩種途徑,後者雖早已於2017年即公告迄今,然目前醫療與法律實務上仍多有疑慮,法規面向亦有法律漏洞,容易造成遊民、無家屬病人、或者與「最近親屬」關係不佳之病人可能淪為推廣器官捐贈風氣下之潛在受害者。本文將簡要介紹我國器官捐贈制度,並以捐贈者之權益保護為中心進行評析。
Currently, organ donation in Taiwan includes two pathways: “organ donation after brain death (DBD)” and “organ donation after cardiac arrest (DCD).” While the latter was officially announced in 2017, there are still many concerns in medical and legal practice, and legal loopholes exist. This makes homeless individuals, patients without family, or patients with poor relationships with their “closest relatives” potentially victims of the promotion of organ donation. This article will briefly introduce Taiwan’s organ donation system and analyze it with a focus on protecting the rights of donors.
