工作時間之認定影響工資之計算,從而工作時間之意義與範圍至關重要。本文將介紹一則「護理人員向雇主請求加班費,但雙方對工作時間之認定有所爭執」之判決,本件之爭點涉及工作時間、待命時間與休息時間等概念,本文擬藉此判決探討工作時間、待命時間與休息時間之認定與區別。
A pay is based on the affirmation of working time. It’s meaning and the range are therefore important. A judgement would be introduced in this article that nursing staff required overtime to the employer but both of them had disputes on the affirmation of working time. The legal issues are the concepts like working time, standby time and the rest. By introducing this judgment, the affirmations and the differences of working time, standby time and the rest would be discussed.
