工作場所基因檢測在美國所引起之就業歧視爭議【本期企劃】 試閱
Controversies over Employment Discrimination Arising from Genetic Testing in the Workplace in the United States
本文之目的主要就美國雇主對其員工(或求職人)進行工作場所基因檢測所引發之各項就業歧視上之相關爭議,作一全面性之回顧及檢視。同時,本文也對該國在2008年所制定之禁止基因資訊歧視法第二章之重要條款,作一簡要之說明,並探討平等就業機會委員會自2010會計年度起處理相關申訴之情形。最後,在結論則以三個階段為期,提出美國在這方面之經驗,對臺灣未來處理此類新興型態就業歧視之爭議時,所應採取各項具體作為之啟示。
The purpose of this article is to make an evaluation of employment discrimination controversies arising from genetic testing conducted by employers on their employees (or job applicants) in the workplace in the United States. It also outlines serval important provisions of Title II of the Genetic Information Non-Discrimination Act of 2008 and discusses the performance of the Equal Employment Opportunity Commission (EEOC) in curbing genetic information discrimination at work. Finally, in the concluding section, the article offers, through three stages, several proposals for Taiwan in order to face the same challenge in the near future.
