刑事責任能力之精神鑑定主要由精神科醫師提供精神科診斷，以作為整理資料、進行論述並最後達成結論的架構指引。本文旨在讓讀者了解臨床評估與司法精神鑑定的差異，並對於評估過程所能夠使用的方法有粗淺的認識。文中將簡介精神疾病之診斷及評估，評估工具的角色（包括精神狀態檢查、理學檢查及相關輔助測驗），最後再特別提到失憶及詐病之評估。此類內容雖然多為臨床導向，但希望能夠讓法律從業人員也能夠對於此種專業有初步的認識。
The forensic psychiatric assessment in the determination of criminal responsibility is mainly provided by the psychiatrists. The diagnosis made by the psychiatrists leads to the structure of criminal responsibility evaluation. This article provides a brief introduction of the differences between clinical evaluations and forensic assessments and the measures taken during the process. The assessment of mental disorders and the role of the measures including mental status examination, physical examination, and related assessments would be mentioned and concluded with the assessment of amnesia and malinger.
