Introduction to the Forensic Psychiatric Assessments for Criminal Cases (II)
刑事司法精神鑑定,乃運用精神醫學方法協助法院了解當事人或關係人心智與行為的事實。近年來,刑事司法精神鑑定之爭議對刑事司法精神鑑定之品質與可信度帶來挑戰,因此,本文對刑事司法精神鑑定進行簡要介紹,期待在國民法官法施行後,協助國民法官了解刑事司法精神鑑定,實現重大刑事案件之司法正義。本文第貳節介紹刑事司法精神鑑定之程序及其考量原則;第參節介紹訴訟能力(就審能力)、刑事責任能力、證言能力、監護處分、死刑量刑及教化可能性、受刑能力、詐病、創傷後壓力症等鑑定之要點,強調不同能力有不同內涵,仍須持續將各種法律概念操作化,並避免對於精神醫學名詞之誤解與誤用。最後,期待本文能有助於法學與精神醫學合作探討,並提升刑事司法精神鑑定之理論與品質。
Utilizing psychiatric methods, forensic psychiatric assessment assists the courts to understand the facts regarding the mentality and behaviors of the litigating parties or persons concerned in criminal cases. Recently, debates on criminal forensic psychiatric assessment brought about challenges to the quality and credibility of the assessment. Therefore, the paper briefly introduced some issues in the assessment for criminal cases. It is hoped that after the Citizen Judge Act is completely implemented, the paper could facilitate the citizen judges’ understanding of the assessment and promote the fulfillment of criminal justice. The second section of the paper describes procedure for conducting criminal forensic psychiatric assessment and the principles of its arrangement. The third section addresses the assessment regarding competence to stand trial, criminal responsibility, competency to testify, criminal custody, death penalty sentencing, criminal offender corrigibility, competence to be executed or imprisoned, malingering, and post-traumatic stress disorder. It emphasizes that different capacities have different connotations; legal concepts should be operationalized; and the misunderstanding and misuse of the psychiatric terms must be avoided. Finally, it is hoped that the paper could facilitate the collaboration between psychiatry and law for enhancing the theory and quality of criminal forensic psychiatric assessments.
