依據化粧品衛生管理條例與行政院最新提出的化粧品衛生安全管理法草案,誇大不實的廣告係以行政罰進行管制,然而除了行政不法責任以外,有無可能構成刑事不法,殊值討論。回顧實務見解發現,此類廣告活動可能被涵攝為施行詐術之行為,而構成詐欺罪。就此,實務上分別以廣告內容之真偽以及產品的售價,作為詐欺罪的主客觀不法構成要件的判斷標準,往後於相關類型的討論中足供吾人參考。

英文摘要

This article tries to focus on the criminal liability of misleading cosmetic advertisements, especially on fraud. According to the Statute for Control of Cosmetic Hygiene, there are only administrative penalties but no criminal liability for misleading cosmetic advertisements. However, these advertisements still may constitute fraud. Based on judicial opinions, misleading cosmetic advertisements distribute false information, and the distribution is a fraudulent mean which certainly constitutes fraud. Therefore, although there seems to be only administrative penalty for misleading cosmetic advertisements under the Statute for Control of Cosmetic Hygiene, criminal liability is highly likely to be derived from these advertisements.
