The European Health Data Space and the Framework of Health Data Governance
歐洲健康資料庫是歐盟資料戰略下第一個泛歐盟的共享資料庫，旨在促進歐盟境內健康資料的流通，在保障資料安全與隱私的前提下，同時提升民眾對個人健康資料的控制權，並促進資料經濟。我國在憲判字第13號判決之後，資料法制的改革已經到了一個重要的轉捩點。本文藉由介紹歐盟對於生醫健康資料的法制設計，希望能提供各界思考此一重要議題的參考。
The European Health Data Space (EHDS) is the first pan EU common data space under the European Strategy for Data. EHDS aims to facilitate the flow of health data within EU, thereby promoting people’s controls over their own data and fostering data economy while protecting data security and privacy. The legal system for data regulation has reached a turning point in our country since the issuance of Decision No.13 of the Constitutional Court. The authors hope that this EU viewpoint on health data regulation can shed some light on this issue.
