醫療營業管制之正當性——從美容醫學預收療程費用談起【本期企劃】 試閱
The Legitimacy of Regulating Medical Business: A Discussion on Prepayment for Cosmetic Medicine
由於新型態醫療業務型態的興起,尤其是美容醫學,已超過以往醫療以疾病治療為主要目的的執業範圍,醫療執業方式也導入許多商業的思維與方式。然而,部分營業方式也引起爭議,以「療程」名義對病人進行預先收費方式是其中之一。醫療為受高度管制的特許行業,而美容醫學之性質及管制強度,與以疾病治療為目的的醫療是否應有所區隔,向為各界熱烈討論的議題。本文藉由實務案例,希望藉美容醫學之定性,進一步探討醫療管制之合理性與考量,最後進行關於醫療費用預收的適當性討論。
Due to the rise of new medical business models, particularly cosmetic medicine, the scope of medical practice has expanded beyond the traditional focus on disease treatment. Medical practice has also integrated many commercial ideologies and methods. However, certain business practices have sparked controversies, such as prepayment under the name of “course of treatment”. Healthcare is a highly regulated profession, and the nature and intensity of regulation in cosmetic medicine raise discussions about whether it should be distinguished from ordinary medical practices, becoming a topic of vigorous debate. Through practical cases, this article aims to explore the rationality and considerations of regulating medical practice, and finally discuss the appropriateness of prepayment of medical expenses.
