最低服務年限約款在醫院之運用──以臺灣新竹地方法院107年度竹勞簡字第10號民事判決為例【本期企劃】 試閱

據報導,全臺護理師人力短缺且流動性高,因此醫院和護理師之間多設有最低服務年限之約定。由於過往欠缺法律明文,對此爭議只能憑藉法院透過判決個案解決,直至2015年12月16日勞動基準法終於新增第15條之1加以規範。本文以臺灣新竹地方法院107年度竹勞簡字第10號民事判決為例,探討該規定在醫院與護理師之間具體適用的問題。
It is reported that there is a shortage of manpower and high mobility for the nurses in Taiwan, so there are minimum service period agreements between the hospitals and the nurses. In this regard, the lack of clear text in the past can only be resolved by case law. On December 16, 2015, the Labor Standards Act was added Article 15-1 to regulate this situation. This article takes the summary judgment of HsinChu District Court 107 year zhú-láo-jiǎn-zì No. 10 to discuss the application of this new added regulation.
