Study on the Legal Protection of Quality and Safety of Online Medicine Services
在中國大陸，2022年互聯網診療監管細則（試行）、2022年藥品網絡銷售監督管理辦法等新規制定和實務上監管力度的加強，引領互聯網醫療進入高品質發展的新階段。從保障互聯網醫療品質和安全角度，法律上的應對包括如下要點：加強互聯網醫療的准入監管，嚴防越界互聯網首診，嚴格要求醫師親自診療和先方後藥，明確互聯網醫療相關方的法律責任。在互聯網醫療蓬勃發展的情勢下，國家必然要關注醫療資訊系統安全和醫療數據保護。
Mainland China introduced two new regulations in 2022 (the Rules for Administrating Internet Diagnosis and Treatment (for Trial Implementation) and Measures or Administrating Online Drug Sales) and enforced market surveillance, which led internet medical services to a high quality-oriented new stage. To guarantee the quality and safety of internet medical services, violations related to the following matters should be on watch: access requirements for internet medical services, the first online doctor visit, the doctor’s diagnosis by their hands and online drug sales based on the prescription. And the standard of deciding the legal responsibility of the parties involved in internet medical services should be clear. With the vigorous development of internet medical services, guaranteeing the security of medical information systems and protecting healthcare data is the next core issue for the government.
