Postpartum Maternal Death Due to Pulmonary Embolism: The Art of Evidence Investigation

本件產婦於剖腹產後翌日，因肺栓塞死亡。原告起訴主張醫師遲延轉院致產婦存活機會遭剝奪。雖一審與二審法院判賠，但遭最高法院廢棄發回，嗣更一審定醫師無過失，經最高法院駁回上訴而確定。本文特就本件審理程序中對鑑定意見所踐行之證據調查進行評析。

A female expired on postpartum Day 2 due to pulmonary embolism. The plaintiff claimed medical malpractice for damages caused by the delay transfer. The district and high court found for the plaintiff, yet the supreme court reversed and remanded, and the final decision found for the defendant. This article will comment on the medical testimony with special reference to the art of investigation on testimony.
